The Aam Aadmi Party (AAP) has unequivocally declared the Enforcement Directorate’s (ED) case against Shri Satyendar Jain, a political conspiracy. AAP Senior Leader Atishi denounced the ED’s case which is solely based on statements from hawala operators without recovering any proceeds of crime and highlighted the irony of Jain’s incarceration while these operators roam freely. She emphasized that Shri Satyendar Jain and his wife could not be legally liable as they were not associated with the implicated company.
Cabinet ministers Atishi labeled the entire case as a political conspiracy to hinder AAP’s progress, particularly targeting Shri Arvind Kejriwal’s initiatives like free electricity and Mohalla Clinics. She accused the BJP of arresting AAP leaders to impede their work, asserting that their efforts won’t be deterred by such tactics. The AAP expressed respect for the Supreme Court and the law but disagreed with the court’s decision regarding Satyendar Jain’s bail.
AAP’s Senior Leader and Cabinet Minister Atishi further said, “Yesterday, the Supreme Court decided to decline bail to Shri Satyendar Jain. We respect the Supreme Court and due procedure of law but respectfully disagree with the apex court’s decision. The case in which Shri Satyendar Jain has been incarcerated is completely fake.”
The Senior AAP Leader continued, “During the time frame for which this case has been made, Shri Satyendar Jain was neither the director nor the owner, his wife had an insignificant shareholding. So as per the law, if the company had taken any decisions during this time, Shri Satyendar Jain and any of his family members can’t be legally liable. Shri Satyendar Jain has been arrested for a decision by a company in which neither was he the director, authorized signatory, or shareholder. He was not at all responsible for any decisions made by the company.”
She added that the allegations made on Shri Satyendar Jain are solely based on the statements given by a few notorious hawala operators. Ironically, the ED makes statements through known hawala operators, but without recovering a single rupee of proceeds of crime from Shri Satyendar Jain, the ED has arrested him only. The known hawala operators are still roaming freely.”
“This makes it evident that this entire case is a political conspiracy. A conspiracy to stop the works of the AAP and Shri Arvind Kejriwal. It’s a conspiracy to target the individual who has provided amenities like free electricity, and Mohalla Clinics to Delhiites,” the AAP leader stated.
Atishi mentioned that it’s a known fact that Shri Satyendar Jain’s health is in a precarious state. The entire country has witnessed that he couldn’t climb a step, he’s been through multiple operations in a few months. Despite this, if the Apex Court has decided to send him to jail, then we are in disagreement with the court respectfully. We have complete faith in the judiciary, if not today then tomorrow we will get justice.
The minister affirmed, “The AAP and the Kejriwal government and all its soldiers are not going to get intimidated by such threats and conspiracies. We have been working for the betterment of the people of Delhi and we will continue to do so.”
“The Mohalla Clinic model Shri Satyendar Jain provided is being replicated and praised in the entire country and the world. A person with such good deeds has been targeted wrongfully. Lakhs of individuals get treated in Delhi’s Mohalla Clinics. The BJP can’t run Mohalla Clinics, provide 24×7 free electricity in the states where it’s in power, so to stop Shri Arvind Kejriwal’s works they’re arresting AAP’s leaders and ministers,” Atishi shared.
“I want to convey to the BJP, no matter how many difficulties and hurdles you place in our path, we will not be affected by your conspiracies and intimidations,” She concluded.
While, the Aam Aadmi Party said, “It’s utterly shameful that the ED – CBI at the directions of BJP, have put Shri Satyendar Jain in jail for almost over a year in a completely fake and fabricated case. He was arrested by the Enforcement Directorate (ED) in May 2022 on false charges of money laundering through three companies during 2010-12 and 2015-16.”
The entire case against Shri Satyendar Jain is based on statements of some Hawala operators who layered some money to buy shareholding in three companies in which the wife of Shri Satyendar Jain had negligible shareholding. The hawala operators have provided no proof of Shri Satyender Jain’s involvement and Shri Jain has denied any knowledge of these individuals. Instead of putting those Hawala operators behind bars, they have been left scot-free but the ED has arrested Shri Satyendar Jain. Shri Satyendar Jain and his family received no money whatsoever from these three companies.
ED’s allegations regarding control of companies/involvement in the affairs of the Companies are also completely without any substance since Shri Satyendar Jain and his family have no shareholding, directorship, or land purchase of these companies. Neither he nor his family were undersigned or authorized signatories in the documents on which the ED has filed this case. Admittedly, as per the ED complaint, neither he nor his family has received the amount which came to the three companies, nor did they receive any shares which were issued to the companies. The shareholding in terms of no. of shares of his and his family remained the same during the check period. The shareholding decreased as other co-accused acquired more shares during such a period.
It’s to be noted that, Delhi’s former Health Minister was hospitalized for a few months and later shifted to an Intensive Care Unit (ICU) after he collapsed in the bathroom of Tihar Jail, where he has been detained since mid-2022 on money laundering charges.
Shri Satyendar Jain’s health has been very precarious and he has undergone major spine surgeries from which he still has to recover. He is still suffering from severe pain, numbness, tenderness and imbalance. As per the last diagnosis, the degree of pain suffered by him is 7 out of 10. Due to the imbalance occurring from underlying medical conditions, he also suffered a fall and a fracture.
