Another set of investigations by the Committee on Petitions, Delhi Legislative Assembly revealed serious shortcomings in the handling of social welfare services and healthcare services in the city. The committee has made a number of observations based on the responses filed by government departments, the depositions of officers, government records, and the deliberations of the committee meetings, in the form of separate reports. The first report titled ‘Abrupt Stoppage Of Pensions Of Old Age Citizens In Delhi At Behest Of Hon’ble Lieutenant Governor Of Delhi’, takes up the case of how owing to misinformation by the department, old age pensions for many beneficiaries were discontinued by the Social Welfare Department, GNCTD without providing sound reasons, and without any verification.
While, the second report titled, ‘Conspiracy Of Officials To Sabotage The Functioning Of Mohalla Clinics At The Behest Of Hon’ble Lieutenant Governor Of Delhi’, takes up how Mohalla Clinics were suffering from the serious issue of unavailability of medicines and diagnostic tests in addition to the staff at the Mohalla Clinic not being paid their due remunerations for months.
The committee has now requested the President of India and Union Home Ministry to take cognisance and take appropriate action against the LG and Chief Secretary.
Committee Chairman & MLA Shri Akhliesh Pati Tripathi said, “Chief Secretary, Finance Secretary, Health Secretary and Social Welfare Secretary found guilty of sabotaging the government in the report. The Committee on Petitions of the Delhi Legislative Assembly presented two report titled on ‘Abrupt Stoppage Of Pensions Of Old Age Citizens In Delhi At Behest Of Hon’ble Lieutenant Governor Of Delhi’ and ‘Conspiracy Of Officials To Sabotage The Functioning Of Mohalla Clinics At The Behest Of Hon’ble Lieutenant Governor Of Delhi’ on Thursday. The reports were tabled by Committee Chairman Shri Akhilesh Pati Tripathi. The members of the committee included Smt. Bandana Kumari, Shri B. S. Joon, Shri Dilip Kumar Pandey, Shri Jai Bhagwan, Shri Kartar Singh Tanwar, Shri Kuldeep Kumar, Shri Rajesh Gupta and Shri Saurabh Bhardwaj. Shri Akhilesh Pati Tripathi said, “The Lieutenant Governor of Delhi has directed officials to halt all government operations in the city. In light of this, the second and third reports of the petition committee have been presented, entitled “The committee has revealed that the pension of 4.10 lakh elderly people in Delhi was stopped from June to December, with the clear intention of impacting the outcome of the MCD elections. The BJP, aware that the people of Delhi had rejected them, used the LG to threaten officials and halt the pensions of those who rely on it to survive, including paying for their monthly medication. The officials attempted to shift blame to the Central government for not providing grant funds, but the Deputy Chief Minister, Shri Manish Sisodia, made it clear that the government would support the elderly regardless of funding. The Finance Secretary and the Social Welfare Secretary and Director were found to have deliberately delayed the release of pensions, citing the need to improve the system, causing immense hardship to the vulnerable elderly population.”

MLA Shri Saurabh Bhardwaj said, “Today we have placed two reports of the Petition Committee in front of the members of the Vidhan Sabha. The first report is on the issue of disbursement of pension. It was before Diwali, that wherever an MLA went he would be confronted by angry senior citizens who would tell them that their pension has not been disbursed by the Delhi Government for the past 2-3 months. What can an MLA really do when a senior citizen comes to them and says that they have not received their pension? This was at a time when the entire country was celebrating Diwali and the festivities that followed after it. This is the time when families usually get together and the elderly person in the family would like to buy some extra things for the children. At that time their pension was delayed, which is highly insensitive of the officials who were responsible for this. An elderly lady also came for our Petition Committee meeting and she informed us that her husband is admitted in Safdarjung Hospital and his cancer treatment is ongoing. She said that she wanted to go to the hospital by an auto but due to her delayed pension she had to take the bus. This is the condition of some of these people who depend on this pension.”
He said, “The MLAs after being informed about this issue asked the Social Welfare Department about it. This is a department where the officers should perhaps be the most sensitive as they are dealing with people who are poor and old and those who really depend on this money that is provided to them by the Delhi Government. But the officers in this department behave so rudely with the elderly citizens who come to their office. I am aware of the Lajpat Nagar office, as that’s near my constituency and the officials there are absolutely heartless. If an MLA has written a letter urging the official to assist a person, they just throw the letter aside and do as they wish.”
He added, “We organised a meeting of the Petition Committee on October 21st last year, and with Diwali later in the week, our hope was that the issue be resolved and the pension be disbursed by the time of Diwali. It was in the meeting that we were told that the pension has been delayed by 3 months due to some reasons. We initially thought that it must be some very serious reason as so many elderly citizens of Delhi were facing a problem because of its consequence. But the reason was so trivial and I want the citizens of Delhi to know about this. There are two types of pension that the Delhi Government provides: one is Rs 2000 for those who are below the age of 70, and it is Rs 2500 for those who are older than 70 years.”
Shri Saurabh Bhardwaj said, “Now, a new director has joined the department and her name is Pooja Joshi. She took out a gazette notification of 2009 in 2022, that was how much focused she was on bothering these elderly citizens of Delhi. And she said that according to the notification the sanction authority for the pension should be the district office and not the headquarters. After making this point she blocked the file for a couple of months. The officials at the district then raised their issues and said that they do not have the required facilities to be the sanctioning authority. So, now the officials in the headquarters and those in the district began to argue among themselves and pass the file from one office to another. The elderly citizens meanwhile are running from one office to another. When the Petition Committee asked Ms Pooja about this change and why she had changed the procedure without thinking about the welfare of the elderly citizens, she did not have any clear answer. Ideally the old policy should have continued until a new one was to be in place, but they ended the old policy without starting the new one, and thus inconveniencing the citizens. This was only done so the citizens blame the CM Arvind Kejriwal led state government and blame them for not receiving their pensions.”
He said, “When Ms Pooja Joshi was called for the Petition Committee meeting, she did not have an answer to our questions. Her junior officer agreed that what was done was wrong, and in front of all the committee members Ms Pooja yelled at him. We later found out that he was transferred by the LG to another department. This is what the LG in Delhi does. An officer who can trouble the state government is retained and promoted while an officer who tells the truth and says that this is wrong is transferred out. However in the subsequent meeting of the Petition Committee we ironed out the problems and the officials assured us that between the 5th and the 8th of the subsequent month the pension of the previous month would be disbursed. If this is not followed in the future then we will take action against the concerned officials. The Petition Committee has urged that action be taken against errant officials such as Vikas Pandey, district social welfare officer (South), Pooja Joshi, who was in-charge of troubling senior citizens of Delhi and the Chief Secretary Naresh Kumar, who despite knowing about all of these problems, decided to not take any action.”

Shri Saurabh Bhardwaj added, “The other report that has been placed is about Mohalla Clinics. Whenever a senior dignitary from another state or country visits Delhi they usually come and visit the Mohalla Clinic. There are several Chief Ministers and other senior officials from states such as Telangana, Tamil Nadu, and Maharashtra that have come and visited the Mohalla Clinic and then gone back to their state to implement a similar feature. Mohalla Clinic in a way is a representation of the efficiency of the Delhi Government, it is the main feature of the Delhi Model, along with schools and government hospitals. Because of its importance, it has also become a tool for political issues. Whenever our rival parties want to trouble the Delhi Government, they do something to the Mohalla Clinic – there will either be an investigation on it, or the salaries of doctors working there will be stopped. A few months before the MCD elections, the salaries of doctors and nursing staff of the Mohalla Clinics were stopped, and the free tests conducted here were also disbanded as the funds for it were stopped by the officials. The reason given for this was that the Finance Department has not sanctioned the second instalment of funds for these tests to be carried out.”
He said, “The Principal Secretary (Finance) Shri Ashish Chandra was adamant to stop the second instalment from going through and found an obscure reason to block it. What did he do this time? The Mohalla Clinics have been functioning since 2015 and each time the instalment for the salaries has been approved by the finance department. But for the first time ever the finance department asked for some documents before disbursing the salaries, and these are documents that were never asked before the disbursement of salaries until now. They asked for certain Cabinet Note and other amendments in the government documents. All Cabinet Notes automatically go to the finance department, but he took months to find this note. This note was again sent to him, but it went through a channel consisting of the Principal Secretary (Health) and then it came to the Mohalla Clinic. This note was attached here and again sent to the Principal Secretary (Health) and then it went to the Principal Secretary (Finance) after a period of 1.5 months. So, for something so trivial, the funds of the Mohalla Clinic were stalled for 3 months.”
He added, “What came as a bigger surprise to us all was the fact that the health department had an unspent amount of Rs 70 crore with it, and while only Rs 11 crore was required to provide the salaries of their staff members, they decided to not use this money. We also found out that the Principal Secretary (Finance) Shri Ashish Chandra Verma had put certain conditions on the health department due to which they were not allowed to use this unspent money of theirs. So, at every level the Principal Secretary (Finance) Shri Ashish Chandra has tried to trouble the Delhi Government and obstruct its developmental works. His attempt was to trouble the marginalised citizens of Delhi who depend on funds from the state government. He wanted to cut off the benefits that they receive from Delhi Government, so that when those benefits are not provided to the people, they will blame the state government and the official did all of this just to benefit the BJP in the MCD elections that were held in December last year.”
He concluded, “In the report of the Mohalla Clinic we found some senior officials of the Delhi Government to be involved in this conspiracy against the elected government. These officers are Principal Secretary (Health) Amit Singla and Principal Secretary (Finance) Ashish Chandra, and they were ably supported in their tasks by Chief Secretary Naresh Kumar, who let all of this happen under his supervision. The junior officials of the department also told us under the confidentiality clause that all of this was done under order from the LG. They said that they were given clear instructions to obstruct the work of the elected government and it was told to them that the orders were directly from the LG. We have also written to the Ministry of Home Affairs of the Central Government and the President of India about this and highlighted to them that the role of the LG also needs to be investigated in both these issues.”
Officers reveal arm twisting, atmosphere of fear by Chief Secretary at behest of LG
In its report, the Committee noted that some members had informed the Committee of the fact that some officers had confided in them that they had been arm-twisted by the Chief Secretary at the behest of the Lieutenant Governor to create hurdles in the ongoing welfare works of the elected government. The Committee was shocked to see that even though the Chief Secretary agreed that there was negligence and dereliction of duty on the part of various senior officials in the matters discussed before the Committee, however, he had chosen not to take any action because, in his own words he said “Main Kiss Kiss par action Lu. Aise Toh neeche se upar sab par action lena padega” The Committee noted that this frivolous excuse by the Head of bureaucracy of Government of NCT of Delhi shows his connivance in creating hurdles in the functioning of welfare schemes in the last few months.
RECOMMENDATIONS OF THE COMMITTEE IN PENSION REPORT:
- The Committee recommends that strict Departmental action should be taken against the concerned District Social Welfare Officer, Lajpat Nagar, Mr. Vikas Pandey who failed to perform his duties and did not adhere to mandated protocol.
- The Committee also recommends that there should be better Inter- Departmental coordination and a mechanism between Social Welfare Department and Finance Department, GNCTD in order to fast-track the process of approval and sanction of funds for the purpose of financial assistance, especially in the wake of uncertainty in the release of funds from Government of India in relation to CSS schemes, so that such delays do not occur in the future and the citizens should not be denied of their legitimate benefits.
- Social Welfare Department, GNCTD shall ensure that regular sensitization programs be made a key component of the training modules for officials involved in public dealing 4. A complaint box should be mandatorily placed at all the district offices and other offices of the Social Welfare Department. The Secretary, Social Welfare Department should open this complaint box, record all the complaints, and personally oversee the disposal of such complaints.
- Social Welfare Department, GNCTD shall enforce a verification mechanism to ensure that pensions are verified, sanctioned, and released in a time-bound manner and to the intended beneficiaries.
- Both Social Welfare Department and Finance Department, GNCTD together take up the matter of release of CSS component with concerned officials in the Government of India and resolve any procedural roadblocks that exist in the process.
- The Committee recommends that the Chief Secretary of GNCT of Delhi to take appropriate action against Dr. Pooja Joshi, Director, Social Welfare Department, for causing a wilful delay in the disbursal of old- age pensions to old-age citizens.
- The Chief Secretary of GNCT of Delhi should submit an Action Taken Report on the recommendations by the Committee for serial no(s). 1-7 to the Legislative Assembly of Delhi within thirty working days of the adoption of this report.
- The Committee humbly requests the Hon’ble President of India and Ministry of Home Affairs, Govt of India, to take cognizance of this report of the Petitions Committee and take appropriate action against the Chief Secretary and the Hon’ble Lieutenant Governor.
RECOMMENDATIONS OF THE COMMITTEE IN THE MOHALLA CLINIC REPORT
- The Committee recommends that the movement of files through the Officials of the Departments should be digitized and disposed of in a time-bound manner.
- The Committee recommends that the Health Secretary should minutize his meetings and conduct field visit of at least 3 Mohalla Clinics every week
- The Committee recommends that the Chief Secretary take strict action against the Secretary (Health Department) and Principal Secretary (Finance Department) for willfully causing delay in processing of files and release of funds for the AAMC services and renumeration to the Doctors therein.
- The Chief Secretary, Government of NCT of Delhi should submit an Action Taken Report on the abovementioned recommendations by the Committee (No.1 to No.3) to the Legislative Assembly of Delhi within thirty working days of the adoption of this report.
- The Committee humbly requests the Hon’ble President of India and Ministry of Home Affairs, Government of India, to take cognizance of this report of the Committee on Petitions and take appropriate action against the Chief Secretary and the Hon’ble Lieutenant Governor.
- In the interest of transparency and accountability, the Committee humbly recommends the House to allow live telecast of Committees proceedings and uploading of videos wherever that Committee deems it necessary.

दिल्ली विधान सभा की याचिका समिति द्वारा की गई एक विस्तृत जांच में एलजी के इशारे पर कुछ अधिकारियों द्वारा जानबूझकर दिल्ली की स्वास्थ्य सेवाओं को ठप करने के प्रयास का खुलासा हुआ है। समिति ने सरकारी विभागों द्वारा दायर प्रतिक्रियाओं और अधिकारियों के बयानों, सरकारी अभिलेखों और समिति की बैठकों के विचार-विमर्श के आधार पर कई टिप्पणियां की हैं। समिति ने बुधवार को सदन के समक्ष ‘दिल्ली सरकार के अस्पतालों में दिल्ली के उपराज्यपाल के आदेश पर ओपीडी काउंटरों के कामकाज में गड़बड़ करने’ शीर्षक से एक रिपोर्ट पेश की थी। इसके तहत यह पाया गया कि मैन्युफ़ैक्चर्ड ब्यूरिक्रेटिक बाधाएँ थीं, जिसके कारण दिल्ली के अस्पतालों के ओपीडी काउंटर्स में डाटा एंट्री ऑपरेटरों के लिए निविदाओं के आमंत्रण के लिए अनुमोदन देने में अत्यधिक देरी हुई। साथ ही चिकित्सा सेवाओं की जरूरत वाले दिल्ली के कई लोगों पर इसका असर पड़ा। वित्त विभाग द्वारा निविदा आमंत्रित करने में हुई देरी के कारण अस्पतालों में काफी अफरा-तफरी मच गई, जिससे लाखों गरीब मरीजों को चिकित्सा सुविधायें और ट्रीटमेंट नहीं मिल पाया।
समिति ने भारत के राष्ट्रपति और केंद्रीय गृह मंत्रालय से अनुरोध किया है कि वे इस मामले पर संज्ञान लें और एलजी और मुख्य सचिव के खिलाफ उचित कार्रवाई करें। प्रोजेक्ट्स को पटरी से उतारने में मुख्य सचिव की भूमिका जांच के दायरे में है। उन्हें 30 दिनों में समिति की सिफारिशों पर की गई कार्रवाई की रिपोर्ट प्रस्तुत करने का निर्देश दिया गया है। रिपोर्ट के बाद विधायकों ने जानबूझकर की गई लापरवाही के लिए मुख्य सचिव, स्वास्थ्य सचिव और वित्त सचिव को निलंबित करने की मांग की और इसका सदन में विरोध किया, जिसके चलते अध्यक्ष को सत्र स्थगित करना पड़ा।
रिपोर्ट के बारे में जानकारी देते हुए विधायक सौरभ भारद्वाज ने कहा, “ओपीडी काउंटर मरीजों के प्रबंधन में महत्वपूर्ण भूमिका निभाते हैं, सीएम की छवि खराब करने के लिए एमसीडी चुनाव से पहले सिस्टम से जानबूझकर छेड़छाड़ की गई। स्वास्थ्य और वित्त सचिवों ने एक दूसरे के बीच फाइलों को स्थानांतरित किया, एक जनशक्ति अध्ययन का आदेश दिया और ओपीडी काउंटर कर्मचारियों को अचानक हटा दिया गया। अस्पतालों के ओपीडी काउंटरों पर डीईओ की सेवाएं अचानक समाप्त करने से अस्पतालों में अराजक स्थिति पैदा हो गई। विधायकों ने डीईओ की अनुपस्थिति में अस्पतालों में ओपीडी काउंटर चलाते हुए सुरक्षा गार्ड और सफाई कर्मचारियों को पाया। एक दशक पुरानी व्यवस्था को जानबूझकर ठप कर दिया गया। वित्त विभाग द्वारा आदेशित अध्ययन में कोई ठोस सिफारिश नहीं मिली, लेकिन लाखों लोगों को पीड़ित होने के लिए छोड़ दिया गया।
दिल्ली विधानसभा की याचिका समिति ने ‘उपराज्यपाल के इशारे पर दिल्ली सरकार के अस्पतालों में ओपीडी काउंटरों के कामकाज में गड़बड़ी करने’ के विषय में आज अपनी रिपोर्ट पेश की। याचिका समिति ने अपनी रिपोर्ट में कहा है कि एलजी साहब के इशारों पर हेल्थ सेक्रेटरी और फाइनेंस सेक्रेटरी ने सरकारी अस्पतालों के ओपीडी काउंटर में काम करने वालों कॉनट्रेक्ट वर्कर्स के टेंडर रोक दिए। एआर स्टडी के नाम पर 39 अस्पतालों के टेंडर रोके गए। हेल्थ और फाइनेंस सेक्रेटरी ने जानपूछकर दिल्ली की स्वास्थय व्य्वस्था को चौपट किया है। इसके लिए दिल्ली की विधानसभा में याचिका समिति ने अपनी रिपोर्ट पेश की है। उसमें दिल्ली के हेल्थ सक्रेटरी और फाइनेंस सेक्रेटरी द्वारा की गई लापरवाही और गड़बड़ी को उजागर किया है।
याचिका समिति को गुमराह करने, अपमानजनक आचरण करने और समिति से जानकारी छिपाने का प्रयास करने के कृत्यों के लिए स्वास्थ्य विभाग के सचिव अमित सिंगला, वित्त विभाग के प्रधान सचिव डॉ. ए.सी. वर्मा और वित्त विभाग के उप सचिव मनोज शर्मा के विरुद्ध विशेषाधिकार कार्यवाही शुरू की जाए। यह दिल्ली के सरकारी अस्पतालों में ओपीडी काउंटर बंद कराने के षड्यंत्र में शामिल हैं। दिल्ली विधानसभा को समिति द्वारा दी गई सिफारिशों पर की गई कार्रवाई की रिपोर्ट को मुख्य सचिव तीस कार्य दिवसों के भीतर प्रस्तुत करें। इसके साथ ही समिति ने भारत के राष्ट्रपति और गृह मंत्रालय से अनुरोध किया है कि याचिका समिति की इस रिपोर्ट पर संज्ञान लें और मुख्य सचिव और माननीय उपराज्यपाल के खिलाफ उचित कार्रवाई करें।
दिल्ली विधानसभा सत्र के तीसरे दिन याचिका समिति के अध्यक्ष अखिलेश पति त्रिपाठी ने सदन में चर्चा की मांग की जिसपर याचिका समिति के सदस्य सौरभ भारद्वाज ने अपना पक्ष रखते हुए कहा कि गरीब लोगों के पास इलाज कराने के लिए पैसे नहीं होते वह सरकारी अस्पतालों में इलाज कराने के लिए जाते हैं। दिल्ली के सरकारी अस्पताल में अच्छी स्वास्थ्य सुविधाएं मिलती हैं। दिल्ली के सरकारी अस्पताल दिल्ली की चुनी हुई सरकार की एक बड़ी उपलब्धि बताई जाती है। मगर दिसंबर में नगर निगम चुनाव होने से कुछ महीने पहल दिल्ली के सरकारी अस्पतालों के खिलाफ एक बहुत बड़ा षड्यंत्र रचा गया। इसमें बड़ें-बड़े आईएएस अधिकारी शामिल थे।
समिति को त्रिलोकपुरी विधानसभा से एक शिकायत मिली। इसमें बताया गया कि इन सरकारी अस्पालों में जब पहली बार मरीज जाता है तो वह ओपीडी के काउंटर पर पहुंचता है और अपनी तकलीफ बताता है, वहां मरीज का कंप्यूटराइज्ड कार्ड बनता है। काउंटर पर बैठे कर्मचारी उसे बताते हैं कि उसे किस कमरे में जाकर किस डॉक्टर को दिखाना है। ओपीडी काउंटर पर बैठे आदमी को जानकारी होती है कि उसे किस डॉक्टर के पास भेजना है। 6 महीने पहले दिल्ली के सरकारी अस्पतालों में षड्यंत्र रचा गया कि जहां भी काउंटर पर डेटा एंट्री ऑपरेटर बैठते हैं। इनके जिस भी अस्पताल में टेंडर खत्म हुए, उन अस्पतालों को दोबारा टेंडर बुलाने से मना कर दिया गया। अस्पतालों ने टेंडर कराने की फाइल स्वास्थ्य विभाग में भेजी। हेल्थ सेक्रेटरी अमित सिंघला के पास गई, उन्होंने ये फाइल फाइनेंस डिपार्टमेंट में भेज दी। फाइनेंस डिपार्टमेंट के चीफ यानी प्रिंसिपल सेक्रेटरी फाइनेंस आशीष चिंद्र वर्मा के पास पहुंची। उन्होंने इन 20-20 हजार की नौकरी करने वाले डेटा एंट्री ऑपरेटर के टेंडर रोक दिए। दिल्ली सरकार के फाइनेंस डिपार्टमेंट के प्रिंसिपल सेक्रेटरी लिखते हैं कि ये टेंडर आप तब कर सकते हैं, जब आप इसके अंदर एक स्टडी करा लें। जिसको एडमिनिसट्रेटिव रिफॉर्मस डिपार्टमेंट स्टडी (एआऱ स्टडी) कहते हैं। स्टडी से पता लगेगा कि इन अस्पताल के अंदर ओपीडी के कितने काउंटर चाहिए। इन एआर स्टडी के नाम पर अस्पताल ने अपने ओपीडी काउंटर पर बैठे ऑपरेटर्स को नौकरी से निकाल दिया। अगले ही दिन से अस्पताल के ओपीडी काउंटर पर बैठने वाले लोग ही हट गए। अस्पताल में अव्यवस्था फैल गई। यही हालात दूसरे अस्पतालों में भी दिखाई देने लगे। ऐसे कहके ज्यादातर अस्पतालों में 6-7 महीनों के अंदर जहां भी पुराने टेंडर खत्म हुए नए टेंडर नहीं किए गए। इसका नतीजा यह हुआ कि ओपीडी काउंटर पर लोग नहीं है, कंप्यूटर नहीं है क्योंकि कंप्यूटर भी कॉनट्रेक्ट पर थे। मरीजों को कोई कुछ बताने वाला नहीं है। मरीज परेशान होते रहे, भटकते रहे। दिल्ली के लगभग सभी अस्पतालों में 6-7 महीने अव्यवस्था फैली रही। गरीब आदमी इलाज के लिए सरकारी अस्पताल गया उसे कोई सुविधा नहीं मिल पाई। आम आदमी पार्टी के कई विधायक अस्पतालों की वीडियो लेकर आए, वहां देखा गया कि अस्पतालों में सुरक्षा गार्ड और सफाई कर्मचारियों को ओपीडी काउंटर पर बिठाया गया। वह हाथ से पर्ची बना रहे थे।
इस विषय में समिति ने जांच कर कारण पता करने की कोशिश की तो पता लगा कि स्वास्थ्य विभाग के सेक्रेटरी अमित सिंघला ने शुरुआत में समिति को कोई उत्तर नहीं दिया। वह यह दर्शाते थे कि उन्हें सरकारी अस्पतालों की इस स्थिति के बारे में कोई जानकारी नही है। उसके बाद वित्तीय विभाग के प्रिंसिपल सेक्रेटरी आशीष चंद्र वर्मा उनको बुलाया गया, तो उन्हें इसकी कोई परवाह नहीं थी कि सरकारी अस्पतालों में यह अव्यवस्था फैली हुई है। कई बार सवाल करने पर भी वह समिति को कोई जवाब नहीं देते थे। समिति द्वारा बुलाए जाने पर कहते कि मुझे याद नहीं है, मुझे फाइल देखनी पड़ेगी। फाइल मंगवाने पर वह अफसर को फाइल लेने भेजते मगर अफसर कभी फाइल लेके वापस नहीं आते। इस तरीके से कई बार यह कार्यवाही चलती रही। 28 दिसंबर, 3 जनवरी, 9 जनवरी, 16 जनवरी और 17 जनवरी को यह कार्यवाही हुई। अंत में समिति को यह पता चला की दिल्ली में 2014 से एक सिस्टम चल रहा था, उस सिस्टम में जानबूझकर एक कमी निकाली गई। कमी को निकालकर वापस विभाग में भेज दिया गया। अब विभाग उस कमी को दूर करने के बहाने से अस्पताल के सारे काम ठप कर रहा है।
समिति सदस्य सौरभ भारद्वाज ने कहा कि एआर स्टडी के परिणाम जानने की कोशिश की गई तो पता लगा कि 7 महीने की एआर स्टडी बताती है कि जिस अस्पताल में 13 ओपीडी के काउंटर थे वो 12 होने चाहिए। इस स्टडी का कोई फायदा नहीं था। इस स्टडी के पीछे फाइनेंस और हेल्थ सेक्रेटरी ने एक षड़्यंत्र दिल्ली के काम को ठप करने के लिए रचा था।
समिति ने आशीष चंद्र वर्मा से पूछा कि हमने आपको पहली बार नवंबर में नोटिस भेजा था। आपने एक हफ्ते के अंदर उसका जवाब देना था आपने नहीं दिया। फाइनेंस सेक्रेटरी का कहना है कि मुझे याद नहीं। सचिवालय से फाइल मंगवाई गई तो उसमें साफ लिखा था कि नवंबर के बाद दिसंबर में भी याचिका की कॉपी भेजी गई। उन्होंने कहा कि मुझे याद नहीं, मैं फाइल देखकर फैक्ट्स पर बात करूंगा, मगर क्योंकि मेरे पास फाइल नहीं है इसलिए मैं समिति को उत्तर नहीं दे सकता। फाइनेंस के डिप्टी सेक्रेटरी मनोज शर्मा से फाइल लाने को कहा और साथ में समिति के एक सदस्य को भी साथ भेजा गया ताकि इस बार फाइल मिल सके। डिप्टी सेक्रेटरी जब फाइल लेने जा रहे थे तो वह आशीष जी के सामने से एक फाइल ले जाते दिखे। टोके जाने पर कहते है मैं इसके साथ सचिवालय से दूसरी फाइल लेकर आउंगा। उनसे कई बार कहा गया कि आप फाइल लेने जा रहे हैं तो पहले की फाइल यहीं छोड़ जाए, वह नहीं माने। अंत में जब समिति ने डिप्टी सेक्रेटरी से फाइल ली तो पता लगा यह वही फाइल है जिसे लेने डिप्टी सेक्रेटरी सचिवालय जा रहे थे और इसके लिए कई बार समिति को गुमराह किया गया है।
आशीष चंद्र वर्मा से समिति ने पूछा कि इस फाइल में सबसे पहले नोटिस लगा हुआ है। उन फाइलों में आपके हस्ताक्षर भी हैं। समिति के सदस्य होते हुए हमें बहुत शर्म आई कि हम इतने सीनियर आईएएस अधिकारी को रंगे हाथो झूठ बोलते हुए पकड़ रहे हैं, समिति को गुमराह करते हुए पकड़ रहे हैं। समिति की कार्यवाही की वीडियो भी बनवाई गई है ताकी कोई हमें झूठा साबित ना कर सके। समिति ने फाइनेंस सेक्रेटरी से सीधा सवाल किया है, आपने आईएएस अधिकारी होकर शपथ लेकर झूठ बोला, समिति को गुमराह किया, समिति का समय खराब किया। इस मामले में समिति ने सदन से इन अफसरों के ऊपर उचित कार्यवाही करने की अपील की।
समिति ने हेल्थ सेक्रेटरी से पूछा कि यह आपकी मुख्य जिम्मेदारी है, यह किसकी लापरवाही है। इसपर वह आपस में एक से दूसरे विभाग कीगलती बताते रहे और अंत में अस्पतालों के एचओडी के ऊपर सारी गलती डाल दी, कि एमडी और एमएस ने हमें इसकी जानकारी नहीं दी। समिति सदस्य सौरभ भारद्वाज ने बताया कि सभी 39 अस्पतालों के एमडी और एमएस को समिति ने बुलाया। सभी से शपथपूर्वक साक्ष्य लिया गया। एमडी ने भी कहा कि उन्होंने स्वास्थ्य विभाग को अपनी समस्या बताई मगर उनकी बात नहीं सुनी गई। हर बार यही कहा गया कि जबतक एआर स्टडी नहीं होती नया टेंडर जारी नहीं होगा। समिति की जांच के बाद हेल्थ सेक्रेटरी ने तबतक के लिए पुराने टेंडर की अवधि बढ़ा दी है जबतक एआर स्टडी नहीं होती। हालांकि यह कार्य पहले भी हो सकता था।
समिति सदस्य सौरभ भारद्वाज ने कहा कि इस षड़्यंत्र पर चीफ सेक्रेटरी नरेश कुमार जी से भी बयान मांगा गया कि इसके लिए कौन जिम्मेदार है। चीफ सेक्रेटरी ने कहा कि बहुत सारे सिसटम खराब है हम उन्हें ठीक करना चाहते हैं। याचिका समिति को अपनी जांच में पता लगा कि मुख्य सचिव दिल्ली के उपराज्यपाल महोदय का नाम लेकर अफसरों को डराते धमकाते हैं, और काम करने से रोकते हैं।
रिपोर्ट के हाइलाइट प़ॉइंट
वित्त विभाग का जवाब भ्रामक था और कई अस्पतालों में ओपीडी काउंटरों पर ऑपरेटरों की कमी के कारण नहीं बताए गए थे। रिपोर्ट में जब यह सवाल किया गया कि सबसे पहले स्टडी कराने की जरूरत किसे है, तो स्वास्थ्य विभाग के सचिव कोई सीधा जवाब नहीं दे पाए।
स्वास्थ्य सचिव ने समिति को इस संबंध में कोई सीधा जवाब देने से इनकार कर दिया। समिति को बार-बार एक ही सवाल पूछने के लिए मजबूर किया गया और स्वास्थ्य सचिव ने केवल अस्पष्ट और टालामटोल वाले जवाब दिए। इसके फलस्वरूप समिति स्वास्थ्य सचिव के खिलाफ विशेषाधिकार कार्यवाही शुरू करने के लिए विवश थी।
स्वास्थ्य सचिव ने बहुत बाद में स्वीकार किया कि वह वित्त विभाग के विशेष सचिव कुलानंद जोशी और निहारिका नियमित रूप से संपर्क में थे। जिनके साथ उन्होंने इस मुद्दे पर चर्चा की। प्रमुख सचिव को भी सूचित किया। स्वास्थ्य सचिव ने आगे कहा कि वित्त विभाग को सौंपी गई सभी फाइलों में डीईओ सेवाओं को जारी रखने की आवश्यकता पर जोर देने वाला एक नोट था। स्वास्थ्य सचिव अमित सिंगला ने कहा कि वह नियमित रूप से वित्त विभाग के सभी अधिकारियों को ओपीडी काउंटरों पर प्रशिक्षित स्टाफ की अनुपलब्धता के कारण इन अस्पतालों में गरीब मरीजों को आ रही परेशानियों के बारे में अवगत कराते रहे थे।
याचिका समिति की सिफ़ारिश
समिति ने विधान सभा से सिफारिश की है कि अस्पतालों को टेंडर जारी करने के बजाय अपने स्वयं के कंप्यूटर सिस्टम खरीदने चाहिए। डीईओ को नियुक्त करने के लिए टेंडर हर 2 साल में बिना असफल हुए फिर से जारी किए जाने चाहिए और किसी भी विस्तार को केवल एमएस स्तर पर ही निपटाया जाना चाहिए। यह भी कि यदि सभी एआर स्टडी किए जाने हैं तो इसे एक साथ या टेंडर जारी करने से पहले किया जाना चाहिए, जबकि डीईओ लगे हुए हैं, इसके बजाय कि पहले डीईओ को हटाया जाए और फिर अध्ययन किया जाए। वही समिति ने यह भी अनुशंसा की है कि मुख्य सचिव , स्वास्थ्य सचिव एवं वित्त विभाग के प्रमुख सचिव के विरुद्ध जानबूझ कर ओपीडी काउंटरों पर डीईओ से संबंधित फाइलों के प्रसंस्करण में देरी करने के लिए कड़ी कार्रवाई की जाए। इसके साथ ही समिति को गुमराह करने, अपमानजनक आचरण करने और समिति से जानकारी छिपाने का प्रयास करने के कृत्यों के लिए स्वास्थ्य विभाग के सचिव अमित सिंगला, वित्त विभाग के प्रधान सचिव डॉ. ए.सी. वर्मा और वित्त विभाग के उप सचिव मनोज शर्मा के विरुद्ध विशेषाधिकार समिति की कार्यवाही शुरू की जाए। दिल्ली विधानसभा को समिति द्वारा की गई सिफारिशों पर की गई कार्रवाई की रिपोर्ट को मुख्य सचिव तीस कार्य दिवसों के भीतर प्रस्तुत करें। इसके साथ ही समिति ने भारत के राष्ट्रपति और गृह मंत्रालय से अनुरोध किया है कि याचिका समिति की इस रिपोर्ट का संज्ञान लें और मुख्य सचिव और माननीय उपराज्यपाल के खिलाफ उचित कार्रवाई करें।
समिति की सिफारिशें
- समिति अनुशंसा करती है कि अस्पतालों को अपने स्वयं के कम्प्यूटर सिस्टम खरीदने चाहिए बजाए इसके लिए निविदा जारी करने के।
- समिति अनुशंसा करती है कि डीईओ को नियुक्त करने के लिए निविदा बिना चूके हर 2 साल में फिर से जारी की जानी चाहिए और किसी भी विस्तार को केवल एमएस स्तर पर ही निपटाया जाना चाहिए।
- समिति अनुशंसा करती है कि यदि सभी एआर अध्ययन किए जाने हैं तो इसे एक साथ या निविदा जारी करने से पहले किया जाना चाहिए जब डीईओ लगे हुए हैं। बजाय इसके कि पहले डीईओ को हटाया जाए और फिर अध्ययन किया जाए।
- समिति अनुशंसा करती है कि ओपीडी काउंटरों में डीईओ से संबंधित फाइलों की प्रक्रिया में जानबूझकर देरी करने के लिए मुख्य सचिव, सचिव स्वास्थ्य विभाग और प्रमुख सचिव, वित्त विभाग के खिलाफ सख्त कार्रवाई करें।
- समिति सिफारिश करती है कि समिति को गुमराह करने के कार्य, अपमानजनक आचरण और समिति से जानकारी छिपाने का प्रयास करने पर (i) अमित सिंगला, सचिव, स्वास्थ्य विभाग (ii) डॉ एसी वर्मा, प्रमुख सचिव, वित्त विभाग और (iii मनोज शर्मा, उप सचिव, वित्त विभाग के खिलाफ विशेषाधिकार कार्यवाही शुरू की जाए।
- दिल्ली सरकार के मुख्य सचिव को समिति (संख्या 1 से संख्या 5) की उपरोक्त सिफारिशों पर की गई कार्रवाई के संबंध में तीस कार्य दिवसों के भीतर दिल्ली विधानसभा को रिपोर्ट प्रस्तुत करनी चाहिए।
- समिति भारत के राष्ट्रपति और गृह मंत्रालय से विनम्र अनुरोध करती है कि याचिका समिति की इस रिपोर्ट का संज्ञान लें और मुख्य सचिव और उपराज्यपाल के खिलाफ उचित कार्रवाई करें।
