The Aam Aadmi Party (AAP) has leveled some grave charges at the Bharatiya Janata Party (BJP), affirming that BJP is engineering a ‘manmade constitutional crisis’ in the capital city of Delhi. Senior AAP leader and MLA, Shri Dilip Pandey, asserted that the BJP’s agenda aims to instill the belief among Delhiites that a constitutional crisis looms, providing a pretext for the imposition of President’s rule. A blatant disregard for the nation’s Constitution and democratic principles, the BJP’s ulterior motive to assert dominance over the populace of Delhi. These charges by the AAP leader come amidst claims that the BJP-led central government is deliberately leaving key positions vacant, further exacerbating the perceived crisis.

Senior leader of the Aam Aadmi Party (AAP) and Timarpur MLA, Shri Dilip Pandey, addressed a press conference at the party headquarters on Friday, stating that the BJP has no regard for the country’s constitution and democratic principles. They are gearing up to defy the overwhelming mandate of the people of Delhi. The BJP is attempting to create a constitutional crisis in Delhi, using the President’s rule as a pretext to sideline the popular government and the will of the people.

The Timarpur MLA continued, “Lieutenant Governor of Delhi (LG) has failed to fill vacant positions in Delhi for years and has been unsuccessful in fulfilling his responsibilities. Despite this, he has been consistently writing letters to the Ministry of Home Affairs (MHA) on transferred subjects. While the LG himself has publicly acknowledged that certain transferred subjects fall outside his jurisdiction. When it comes to issues like pollution in Delhi, they label it as a transferred subject, and when it’s about unauthorized colonies, they portray it as a transferred matter, thus undermining the Delhi government’s efforts. Now, the LG is writing letters to the Home Ministry on these same transferred subjects. LG is maintaining double standards. He is stating in the letters written to the Home Ministry that he is calling relevant ministers for meetings, but they are not attending; the Delhi government is not being run according to rules and procedures.”

The AAP MLA affirmed that when officials are summoned for essential maintenance work in Delhi, the LG conveniently cites the code of conduct at the behest of the BJP. It is clear that the BJP is currently attempting to create a constitutional crisis in Delhi, aiming to impose President’s rule by disregarding the mandate of the people. All Delhiites are entirely satisfied with the AAP government’s work whether electricity, water, Mohalla Clinics, Schools, or Hospitals. The announcement of CM Shri Arvind Kejriwal’s scheme to provide a monthly honorarium of ₹1,000 to women under the ‘Mukhya Mantri Mahila Samman Yojana’ has elicited cheers from women across Delhi. Despite this, the BJP’s attempts of this nature bring disgrace upon them and indicate that they have no regard for the constitution and democracy.

“Article 356 of the Indian Constitution outlines the circumstances under which the President’s rule can be imposed. The Supreme Court has thrice dismissed PILs seeking the removal of Delhi’s CM Shri Arvind Kejriwal, citing a constitutional crisis. This proves that there is nothing unconstitutional in Delhi. Section 93 of Article 356 provides for six points, defining the situation of a constitutional crisis. If any of these points are not met, President’s rule can be imposed in a state. However, such a situation does not exist in Delhi. So why does the BJP want to create such circumstances that would lead to President’s rule in Delhi? All Delhiites stand with their leader Shri Arvind Kejriwal and the Aam Aadmi Party government. Delhi’s people, MLAs, and councilors have been fighting against the BJP yesterday, today, and will continue to fight in the future,” he affirmed.

Based on these points, the President’s rule can be imposed in a state:

I). Constitutional crisis can be said to exist when there is a minority government in Delhi, but there is no question of minority in Delhi.

II). Even based on the poor law and order situation in Delhi, President’s rule cannot be imposed because it directly comes under the LG and the central government.

III). The Delhi government has not passed any law that goes against the laws made by the central government.

IV).The Delhi government has not refused to comply with any orders approved by the central government.

V). The Delhi government has not done anything that challenges the Supreme Court.

VI). The Delhi government has not done anything against the sovereignty of India
