Given below is the advisory issued to all hospitals/nursing homes in Delhi where organ transplantation surgeries are performed, following the recent shameful incident at the Indraprastha Apollo Hospital :

ADVISORY

ON TRANSPLANTATION OF HUMAN ORGANS

I am directed to convey that; In keeping with the right to life, liberty, privacy guaranteed to an individual under Article 21 of the Constitution of India, Transplantation of Human Organs and Tissues Act was passed in the year 1994. This paved the way for promoting organ transplantation for therapeutic purposes in India. The same is undertaken within the Transplantation of Human Organs and Tissues Rules, which were updated in the year 2014.

The basic premise behind the act and the rules has been to ensure that donation of organs (especially from a living donor) is purely for altruistic reasons, out of love and affection andit is free from any financial transaction or in lieu of its assurance in future in any manner between recipient and donor and there is no pressure or / coercion of any kind on the donor.

The Health Department, Govt. Of NCT Delhi hereby reiterates its directive on this subject that all the hospitals in Delhi where organ transplantation is performed must follow the Transplantation of Human Organs and Tissues Act and the Rules in letter and spirit.

This issues with the approval of Directorate General of Health Services, Govt. of NCT of Delhi.

सभी अस्पतालों को मानव अंगों के प्रत्यारोपण के बारे में निर्देश

भारत के संविधान के अनुच्छेद 21 के तहत किसी व्यक्ति के जीवन का अधिकार, स्वतंत्रता का अधिकार और निजता के अधिकार की गांरटी को मूर्त रूप देने के उद्देश्य से 1994 में ट्रांसप्लांटेशन ऑफ ह्यूमन ऑर्गन्स एंड टिश्यूस एक्ट पारित किया। इससे भारत में थेरेपी के उद्देश्य अंग प्रत्यारोपण के प्रोत्साहन का मार्ग प्रशस्त हुआ। 2014 में अपडेटेड ट्रांसप्लांटेशन ऑफ ह्यूमन ऑर्गन एंड टिश्यूस रूल्स में भी यही भावना रही। इस एक्ट और रूल्स की मूल भावना यह है कि अंगों का दान (विशेषकर जीवित व्यक्तियों के अंगों का दान) पूरी तरह से परोपकार की भावना से हो। अंग दान में किसी तरह का वित्तीय लेन-देन न हो। इसके अलावा भविष्य में भी किसी तरह के लेन-देन को लेकर दानदाता और दानकर्ता के बीच किसी तरह का दबाव न हो।
इसी संबंध में दिल्ली सरकार के स्वास्थ्य विभाग ने दिल्ली सरकार के अधीन आने वाले ऐसे अस्पतालों को निर्देश जारी किया है, जहां अंगों का प्रत्यारोपण किया जाता है, कि वे ट्रांसप्लांटेशन ऑफ ह्यूमन ऑर्गन्स एंड टिश्यूस एक्ट एंड रूल्स का पूरी तरह पालन करें।
