Text of AAP Delhi convenor Mr Gopal Rai’s letter to BJP Delhi President Manoj Tiwari :
Respected Tiwari ji,
five years back You and your party had promised to make Delhi a full state , and on the basis of that promise people of Delhi made your party victorious on all seven seats of Delhi.
After five years however, neither you nor your party did anything on statehood for Delhi. The obvious question is why did you deceive the innocent people of Delhi ?
Now when the Aam Aadmi Party has launched a full scale and intensive struggle for full statehood for Delhi, you are consistently and repeatedly stating that Delhi can’t be given full statehood since the hon’ble Supreme Court of India has denied it. This is a blatant lie and you are misleading the people of Delhi by propagating this lie.
The Fact is that hon’ble Supreme Court has given no such verdict on the statehood for Delhi.
In case you are talking about the 4th July 2018 Five judge Constitution Bench judgment or the 14th February 2019 two judge verdict, I am attaching the relevant portion of these judgments, in which the hon’ble Court has observed about the status of Delhi.
It is also reproduced below :
Page 229 :
“The status of NCT of Delhi is sui generis, a class apart, and the status of the Lieutenant Governor of Delhi is not that of a Governor of a
State, rather he remains an Administrator, in a limited sense, working with the designation of Lieutenant Governor.
With the insertion of Article 239AA by virtue of the Sixty ­ninth Amendment, the Parliament envisaged a representative form of Government for the NCT of Delhi. The said provision intends to provide for the Capital a directly elected Legislative Assembly which shall have legislative powers over matters falling within the State List and the Concurrent List, barring those excepted, and ammandate upon the Lieutenant Governor to act on the aid and advice of the Council of Ministers except when he decides to refer the matter to the President for final decision”.
In case you have anything else other than what is mentioned above, please put that in public domain.
Through this letter I have the following questions for you :
1) Which case regarding full statehood for Delhi was filed in the Supreme Court of India ?
2) Who had filed the case in the Supreme Court for statehood of Delhi ?
3) Are you not aware that full statehood for Delhi will be granted by parliament through a Constitutional amendment bill, are you deliberately misleading the people of Delhi ?
4) You have been repeatedly saying that Delhi can’t be granted statehood since Arvind Kejriwal sat on a dharna outside Rail Bhawan in January 2014, then why did your party promise statehood for Delhi in March 2014, when BJP released a Delhi-specific manifesto ?
5) What is BJP’s stand on statehood for Delhi, is what you are saying is the official stand of BJP or your personal opinion ?
On 30th March, I had asked you publicly about the hon’ble Supreme Court’s view on statehood for Delhi, but you have not replied so far. In case you have an answer please respond to this letter and remove the misgivings.

सोमवार को एक प्रेस वार्ता को संबोधित करते हुए दिल्ली प्रदेश संयोजक एवं कैबिनेट मंत्री गोपाल राय ने कहा कि 30 मार्च 2019 को हमने एक प्रेस वार्ता के माध्यम से जनता को भाजपा सांसद मनोज तिवारी द्वारा बोले जा रहे झूठ से अवगत कराया था। परंतु उसके बाद भी वह लगातार दिल्ली की जनता से पूर्ण राज्य को लेकर सुप्रीम कोर्ट के आदेश के बारे में झूठ फैलाने का काम कर रहे हैं।
गोपाल राय ने कहा जैसा कि हमने पिछली प्रेस वार्ता में भाजपा के प्रदेश अध्यक्ष मनोज तिवारी से सुप्रीम कोर्ट के आदेशों को लेकर 3 प्रश्न पूछे थे। अभी तक मनोज तिवारी जी की ओर से कोई भी जवाब नहीं आया है। उसी श्रंखला में आज मैं लिखित रूप में मनोज तिवारी जी से सुप्रीम कोर्ट के दोनों आदेशों पर वही प्रश्न दोहरा रहा हूं।
मनोज तिवारी जी बार-बार जनता के बीच सार्वजनिक तौर पर सुप्रीम कोर्ट के आदेश का हवाला देकर जो कहते हैं, कि सुप्रीम कोर्ट ने दिल्ली को पूर्ण राज्य का दर्जा देने से मना किया है। मैं सुप्रीम कोर्ट के दोनों आदेशों की कॉपी इस पत्र के साथ संलग्न कर रहा हूं। मनोज तिवारी जी बताएं कि इन आदेशों में सुप्रीम कोर्ट ने दिल्ली को पूर्ण राज्य का दर्जा देने के लिए कहा मना किया है। और अगर इन आदेशों से अलग सुप्रीम कोर्ट का कोई अन्य आदेश उनके पास है तो हमें भी उस आदेश की एक कॉपी उपलब्ध कराएं।
गोपाल राय ने कड़े स्वरों में मनोज तिवारी जी को चेताते हुए कहा, कि अगर उन्होंने हमारे प्रश्नों का इस बार भी जवाब नहीं दिया, और इसी प्रकार से जनता के बीच झूठ फैलाने का काम करते रहे, तो हम सुप्रीम कोर्ट के दोनों आदेश और मनोज तिवारी जी के सार्वजनिक बयानों के साक्ष्य लेकर चुनाव आयोग में मनोज तिवारी जी एवं भाजपा के खिलाफ शिकायत दर्ज कराएंगे।
