Aam Aadmi Party (AAP) Senior Leader and Rajya Sabha MP Shri Sanjay Singh has written a letter to the Union Finance Secretary, seeking sanction for prosecuting ED Director Sanjay Kumar Mishra and Assistant Director Jogender, Assistant Director. The request has been made to prosecute the officers under Section 499 r/w Section 500 of the Indian Penal Code, 1860, for making defamatory and untrue statements about Shri Sanjay Singh.
In a supplementary prosecution complaint filed under the Prevention of Money Laundering Act, 2002, on 6th April 2023, Sanjay Kumar Mishra and Jogender have made certain untrue and defamatory statements against Shri Sanjay Singh. They have deliberately and maliciously imputed his involvement in a Liquor Policy matter without any basis, thereby attempting to tarnish his reputation.
The MP has stated that the alleged statement, by one Dinesh Arora, does not attribute any wrongdoing whatsoever to him. However, the officers have made false allegations against him, which have been widely circulated and published in the media, causing severe dishonour and disrepute to him.
As officers of the Directorate of Enforcement, carrying out investigations into the matter, Sanjay Kumar Mishra and Jogender were obligated to make only truthful assertions in judicial proceedings. However, contrary to such obligation, they have filed a complaint falsely attributing illegal actions to Shri Sanjay Singh without any basis and have knowingly made false statements in the complaint filed before the Trial Court.
Shri Sanjay Singh has alleged that the officers have misused their position to make patently untrue incorrect statements, which has tarnished and blemished his goodwill and reputation. Such false statements have been made by the officers with the intent to falsely implicate or frame him, hence Sanjay Kumar Mishra and Jogender are liable to be prosecuted.
The MP has urged the Finance Secretary to grant sanction for prosecuting the officers, who have violated their legal obligations and caused severe damage to his reputation. He has also stated that the Finance Secretary is bound to grant the sanction for prosecution within three months, failing which it would be deemed to be accorded, as per law.
Earlier on 22nd April, Shri Sanjay Singh had demanded the ED to issue a public apology to him within 48 hours. The MP had slapped a legal notice upon the Enforcement Directorate (ED) for tarnishing and mutilating his public image. According to the notice sent by the MP, the ED attempted to popularise a perverse, false, motivated, wild, malicious, and baseless campaign to defame him. He had further asserted that the statements made by the ED officials were untrue, defamatory, and incriminating. The MP’s lawyers had served a notice to ED Director Sanjay Kumar Mishra and Additional Director Jogender. They had demanded a public apology from the ED officials within 48 hours failing which, civil and criminal proceedings were to be initiated against them.
