Chief Minister Shri Arvind Kejriwal wrote a strongly worded letter to the Delhi LG over his blatant misuse of powers on Friday. The CM expressed deep concern over the impending MCD crisis as well. Imploring the LG to not play with the democratic system of Delhi, Shri Arvind Kejriwal tweeted, “Please allow the elected government to fulfil dreams of 2 crore Delhiites; let’s respect the Constitution & strengthen democracy.” Through his letter the CM stated, “The LG is directly issuing orders on practically every subject irrespective of whether it is reserved or transferred. The Elected government is supposed to nominate MCD Aldermen; shocking and saddening how LG dictated his pickings without consulting the government. The tradition of appointing senior most councillor as presiding officer was thrown to the winds; the elected government’s power of appointing as the presiding officer was infringed by LG. The LG stole Delhi Government’s right to appoint Haj Committee members and nominated a new committee without consulting the elected government. Such practice of directly issuing directions to officers and getting notifications done is illegal and unconstitutional.” The letter further details how the LG and the CS are together running a parallel government and issuing orders and publishing notifications by bypassing the elected government. In a separate tweet, the CM also raised the matter of how the Article 243R of the Constitution clearly debars nominated members from voting in the House and attempts to get them to vote in the House is unconstitutional.
In his letter, Chief Minister Shri Arvind Kejriwal said, “Strange things are happening in the governance of the capital of India. As per the Constitution of India, there is a democratically elected government in Delhi. Barring three “reserved” subjects namely police, public order and land, executive control over all other subjects in concurrent and state lists lie with the elected govt. The subjects in the control of elected govt are popularly called “transferred” subjects. Hon’ble LG has executive control over the three reserved subjects.”
He added, “Last few weeks have seen some very bizarre developments. Hon’ble LG is directly issuing orders on practically every subject irrespective of whether it is reserved or transferred, irrespective of whether Hon’ble LG has the powers to do that or not. Hon’ble LG issues directions directly to the Chief Secretary who in turn gets them implemented completely bypassing and ignoring the elected govt. One would ask why are the officers implementing LG’s illegal orders? Because Hon’ble LG has complete control over the bureaucracy. LG has power to transfer, suspend or take any other action against any employee of Delhi Government. Unfortunately, the elected government of Delhi has no control over employees. Therefore, Delhi government officers do not have the courage to say no to LG even if his orders are completely bizarre.”
He continued, “For instance, as per Delhi Municipal Corporation Act, 10 members with specialised knowledge could be nominated by the state govt. Till date, for the last many decades, these ten members were always nominated by the elected govt of Delhi. This practice was followed by the previous LG, Shri Anil Baijal also. However, the present LG, one morning, dictated ten names (obviously all with BJP background) and directed the Chief Secretary to issue notification. The Chief Secretary complied. Elected govt came to know from the newspapers. Since this is a transferred subject, as per the Constitution, it is the elected govt which has the power to nominate these members.”
He further wrote, “Likewise, as per Delhi Municipal Corporation Act, one of the councillors is nominated as presiding officer for administering oath to all councillors on the first day and for conducting the election of Mayor, after which the Mayor takes over. Tradition has been that the senior most member of the House, irrespective of party affiliations, is nominated by the state govt for this job. This time, one morning, Hon’ble LG dictated the name of some BJP councillor and directed the Chief Secretary to issue notification. As always, the Chief Secretary obliged. Interestingly, the person nominated is not the senior most member. Therefore, the erstwhile tradition was also thrown to the winds. The elected govt was completely out of the picture though the Constitution empowers the elected government to nominate the first presiding officer since it is a transferred subject.”
He added, “In another similar bizarre matter, one morning, Hon’ble LG dictated the names of Delhi Haj Committee and directed the Chief Secretary to issue notification. Again, this is a transferred subject and only elected govt has the power to constitute Haj Committee. However, the elected govt was bypassed.”
The CM further argued, “These are not isolated incidents. There have been several such instances in the past. With passage of time, this is now becoming a regular practice. Such practice of directly issuing directions to officers and getting notifications done is illegal and unconstitutional. The government elected by the people with such a thumping majority has been rendered irrelevant. Ordinarily, officers would have refused to follow such bizarre directions. They have been protesting privately and in a muted voice. They are all very scared of consequences if they do not follow these directions. Some have faced the wrath in the past. Control over bureaucracy through “services” is being misused.”
He concluded, “Your Excellency, individuals like me and you are too small. This country is important. India is important. Our democracy, which we got after a long independence struggle, is important. Let’s all work together for the country and to strengthen our democracy. 2 crore people of Delhi elected a govt with such a thumping majority to fulfil their dreams. The elected govt is directly accountable to the people. Please allow the elected govt to work for the people. Let’s respect the Constitution.”

सीएम अरविंद केजरीवाल ने आज एलजी को पत्र लिखकर दिल्ली की चुनी हुई सरकार को दो करोड़ लोगों के सपनों को पूरा करने देने की अपील की है। सीएम अरविंद केजरीवाल ने पत्र के माध्यम से एलजी से कहा है कि मैं और आप बहुत छोटे हैं। यह देश और लोकतंत्र महत्वपूर्ण है। आइए संविधान का सम्मान करें और लोकतंत्र को मजबूत करें। सीएम अरविंद केजरीवाल ने अपने पत्र में पिछले कुछ हफ्तों में एलजी द्वारा गलत तरीके से जारी आदेशों का हवाला देते हुए कहा है कि नियमानुसार, एमसीडी में 10 सदस्यों को दिल्ली सरकार नामित करती आई है, लेकिन इस बार सरकार से बिना परामर्श किए इनको नामित कर दिया। संविधान का अनुच्छेद 243आर साफ तौर से मनोनीत सदस्यों को सदन में मतदान करने से रोकता है। उन्हें सदन में वोट दिलाने की कोशिश असंवैधानिक है। संविधान निर्वाचित सरकार को वरिष्ठ पार्षद को पीठासीन अधिकारी नामित करने का अधिकार देता है, लेकिन इसे दरकिनार किया गया। सीएम ने कहा है कि एलजी और चीफ सेक्रेटरी मिलकर समानांतर सरकार चला रहे हैं और चुनी हुई सरकार को दरकिनार कर आदेश व अधिसूचना जारी कर रहे हैं। दुर्भाग्य से दिल्ली की चुनी हुई सरकार की जगह एलजी के पास कर्मचारियों के खिलाफ कार्रवाई करने की शक्ति है। इसलिए अधिकारी गलत आदेश का भी विरोध नहीं करते हैं।
भारत की राजधानी दिल्ली के शासन में अजीब चीजें हो रही हैं। भारत के संविधान के अनुसार, दिल्ली में लोकतांत्रिक रूप से चुनी हुई सरकार है। पुलिस, सार्वजनिक व्यवस्था और भूमि जैसे तीन ‘आरक्षित’ विषयों को छोड़कर, समवर्ती और राज्य सूचियों में अन्य सभी विषयों पर कार्यकारी नियंत्रण निर्वाचित सरकार के पास है। निर्वाचित सरकार के नियंत्रण वाले विषयों को लोकप्रिय रूप से ‘स्थानांतरित’ विषय कहा जाता है। माननीय एलजी का तीन आरक्षित विषयों पर कार्यकारी नियंत्रण है।
पिछले कुछ हफ्तों में कुछ बहुत ही विचित्र घटनाक्रम देखने को मिले हैं। माननीय एलजी व्यावहारिक रूप से हर विषय पर सीधे आदेश जारी कर रहे हैं, चाहे वह आरक्षित हो या स्थानांतरित हो। भले ही माननीय एलजी के पास ऐसा करने की शक्तियां हों या नहीं। माननीय एलजी सीधे मुख्य सचिव को निर्देश जारी करते हैं, जो निर्वाचित सरकार को दरकिनार और अनदेखा करते हुए उन्हें पूरी तरह से लागू करवाते हैं। कोई पूछेगा कि अधिकारी एलजी के अवैध आदेशों को क्यों लागू कर रहे हैं? क्योंकि नौकरशाही पर माननीय एलजी का पूरा नियंत्रण है। एलजी के पास दिल्ली सरकार के किसी भी कर्मचारी के खिलाफ स्थानांतरण, निलंबन या कोई अन्य कार्रवाई करने की शक्ति है। दुर्भाग्य से, दिल्ली की चुनी हुई सरकार का कर्मचारियों पर कोई नियंत्रण नहीं है। इसलिए दिल्ली सरकार के अफसरों में इतनी हिम्मत नहीं है कि एलजी के आदेश पूरी तरह से बेतुके होते हुए भी उन्हें मना कर दें।
सीएम अरविंद केजरीवाल ने उदाहरण देते हुए पत्र में लिखा है कि दिल्ली नगर निगम अधिनियम के अनुसार, विशिष्ट ज्ञान वाले 10 सदस्यों को राज्य सरकार द्वारा नामित किया जा सकता है। आज तक, पिछले कई दशकों से, इन 10 सदस्यों को हमेशा दिल्ली की चुनी हुई सरकार द्वारा मनोनीत किया जाता था। इस प्रथा का पालन पिछले उपराज्यपाल श्री अनिल बैजल ने भी किया था। हालांकि, एक सुबह उपराज्यपाल ने 10 नाम तय किए (जाहिर तौर पर सभी भाजपा पृष्ठभूमि वाले) और मुख्य सचिव को अधिसूचना जारी करने का निर्देश दिया। मुख्य सचिव ने निर्देश का अनुपालन किया और चुनी हुई सरकार को अखबारों से पता चला। जबकि यह एक स्थानांतरित विषय है और संविधान के अनुसार, निर्वाचित सरकार के पास इन सदस्यों को मनोनीत करने की शक्ति थी।
इसी तरह, दिल्ली नगर निगम अधिनियम के अनुसार, पहले दिन सभी पार्षदों को शपथ दिलाने और मेयर का चुनाव कराने के लिए पार्षदों में से एक को पीठासीन अधिकारी के रूप में नामित किया जाता है, जिसके बाद मेयर पदभार ग्रहण करता है। परंपरा यह रही है कि सदन के वरिष्ठतम सदस्य, पार्टी संबद्धता के बावजूद, इस कार्य के लिए राज्य सरकार द्वारा नामित किया जाता है। वहीं इस बार, एक सुबह, माननीय एलजी ने कुछ भाजपा पार्षद का नाम तय किया और मुख्य सचिव को अधिसूचना जारी करने का निर्देश दिया। हमेशा की तरह मुख्य सचिव ने अनुपालन किया। दिलचस्प बात यह है कि नामांकित व्यक्ति वरिष्ठतम सदस्य नहीं है। इसलिए पुरानी परंपरा को भी दरकिनार कर दिया गया। निर्वाचित सरकार पूरी तरह से इस मामले से बाहर थी। हालांकि संविधान निर्वाचित सरकार को पहले पीठासीन अधिकारी को नामित करने का अधिकार देता है, क्योंकि यह एक स्थानांतरित विषय है।
इसी तरह के एक और विचित्र मामले में, एक सुबह माननीय एलजी ने दिल्ली हज कमेटी के नाम तय किए और मुख्य सचिव को अधिसूचना जारी करने का निर्देश दिया। यह भी एक स्थानांतरित विषय है और केवल निर्वाचित सरकार के पास हज कमेटी गठित करने की शक्ति है। लेकिन यहां भी निर्वाचित सरकार को दरकिनार कर दिया गया।
इस तरह की सिर्फ यही घटनाएं नहीं हैं, बल्कि पूर्व में भी ऐसे कई मामले सामने आ चुके हैं। समय के साथ, अब यह एक नियमित अभ्यास बनता जा रहा है। अधिकारियों को सीधे निर्देश जारी करने और अधिसूचना करवाने की यह प्रथा अवैध और असंवैधानिक है। इतने प्रचंड बहुमत से जनता द्वारा चुनी गई सरकार अप्रासंगिक हो गई है। आमतौर पर अधिकारी ऐसे अजीबोगरीब निर्देशों को मानने से इन्कार कर देते। वे निजी तौर पर और मौन स्वर में विरोध करते रहे हैं। वे सभी इन निर्देशों का पालन न करने पर परिणामों से बहुत डरते हैं। पूर्व में कुछ ने विरोध करने पर इनकी नाराजगी का सामना भी किया है। एक तरह से ‘सेवाओं’ के माध्यम से दिल्ली की नौकरशाही पर नियंत्रण का दुरुपयोग किया जा रहा है।
सीएम अरविंद केजरीवाल ने पत्र के आखिर में लिखा है, मैं और आप बहुत छोटे हैं। यह देश महत्वपूर्ण है। भारत महत्वपूर्ण है। हमारा लोकतंत्र, जो हमें लंबे स्वतंत्रता संग्राम के बाद मिला है, यह महत्वपूर्ण है। आइए, हम सब मिलकर अपने देश और लोकतंत्र को मजबूत करने के लिए काम करें। दिल्ली के दो करोड़ लोगों ने अपने सपनों को पूरा करने के लिए इतनी प्रचंड बहुमत वाली सरकार चुनी है। चुनी हुई सरकार सीधे जनता के प्रति जवाबदेह होती है। कृपया चुनी हुई सरकार को जनता के लिए काम करने दें। आइए, संविधान का सम्मान करें।

सदन में नामित सदस्यों से वोट दिलाने की कोशिश असंवैधानिक- अरविंद केजरीवाल
संविधान में निर्धारित भूमि के कानून का हवाला देते हुए, सीएम अरविंद केजरीवाल ने आज एक ट्वीट कर कहा कि संविधान का अनुच्छेद 243आर स्पष्ट रूप से नामित सदस्यों को सदन में मतदान करने से रोकता है और उन्हें सदन में मतदान कराने का प्रयास असंवैधानिक है।
